Általános Szerződési Feltételek (ÁSZF)

1. These General Terms and Conditions (GTC) govern the use of the website sportbetting-ai.tips (hereinafter "the Platform"), operated by the Operator (hereinafter "the Operator").
2. By accessing or using the Platform, the user agrees to these GTC in their entirety. If you do not agree, you must discontinue use of the Platform immediately.
3. The Operator reserves the right to amend these GTC at any time. Changes become effective upon publication on this page. Continued use of the Platform after changes constitutes acceptance of the amended terms.
4. The Platform provides a paid digital service in the form of AI-generated statistical analyses and betting recommendations. The VIP Pass System constitutes the contractual service.
5. A contract between the user and the Operator ("Service Agreement") is concluded upon registration on the Platform. The user becomes a contracting party and accepts these GTC as the contractual basis. This creates a binding contractual relationship within the meaning of §§ 145 ff. BGB (German Civil Code).
6. The contractual relationship is based on the provision of digital services in accordance with §§ 327 et seq. BGB. The Operator owes the user functional access to the Platform and, in the case of a VIP Pass, the contractual scope of AI analyses.
7. The Operator acts as a digital service provider within the meaning of the German Digital Services Act (DDG) and the Telemedia Act (TMG). The Platform does NOT fall under the scope of the German Interstate Treaty on Gambling (GlüStV), as no gambling is offered or brokered.

1. The Platform provides AI-generated statistical analyses for football matches across major European leagues. The AI system processes publicly available statistical data according to a defined analytical schema and generates betting recommendations and possible match outcomes.
2. The AI system exclusively evaluates statistical data including but not limited to: team form, injury reports, head-to-head records, home/away performance, and league standings. Based on this data, the system generates recommendations according to a fixed algorithmic schema.
3. The Operator is not a betting provider or financial advisor. The Platform does not accept bets, manage betting accounts, or process any betting-related transactions.

1. The Platform offers a VIP Pass System providing access to enhanced AI analyses and features. The VIP Pass constitutes the core paid service of the Platform.
2. VIP Pass activation is available via direct payment via Stripe: €59.99 for 1 month or €239.94 for 6 months (33% discount). No automatic renewal. Promotional campaigns by the Operator may also grant VIP access.
3. VIP Passes have no monetary value and cannot be redeemed, transferred, sold, or exchanged for cash or any other form of compensation.
4. The Operator reserves the right to modify, suspend, or discontinue the VIP Pass System at any time without prior notice. Active VIP Passes remain valid for their remaining duration unless terminated for cause.
5. In cases of suspected fraud, abuse, manipulation, chargeback fraud, or multiple accounts, the Operator may immediately deactivate the VIP Pass without notice or compensation.
6. No refund, compensation, or claim for damages arises from the deactivation, modification, or discontinuation of the VIP Pass System. This does not affect statutory warranty rights under §§ 327–327u BGB for defective digital products (e.g., price reduction or refund in case of material defects that the Operator fails to remedy within a reasonable period).

1. Use of the Platform is strictly limited to persons aged 18 or older. The user confirms their legal age upon each use.
2. The user is solely responsible for ensuring compliance with all applicable gambling, betting, and financial laws in their country or jurisdiction of residence.
3. The user acknowledges that sports betting is gambling and involves significant financial risk, including the potential loss of all deposited funds.

   • Providing false information (age, identity, residence)
   • Creating multiple accounts
   • Manipulating or abusing the VIP Pass System
   • Using the Platform for any illegal purpose
   • Automated access (bots, scrapers, crawlers) without express written permission
   • Reverse engineering, decompiling, or attempting to extract the AI system's algorithms or data models
   • Reselling, redistributing, or sharing VIP content or analyses
   • Sharing your account credentials (username and password) with third parties. Each account is strictly personal and non-transferable.
   • Sharing, forwarding, publishing, or distributing tips, analyses, recommendations, or any other VIP content provided by the Platform to third parties — whether free of charge or for a fee — including but not limited to sharing via messaging apps, social media, forums, screenshots, or any other medium
   • Using the same account simultaneously on multiple devices. Only one active session per account is permitted at any time.
5. The Operator reserves the right to immediately block, suspend, or terminate access in case of any violation of these terms, without prior notice or compensation.

1. All statistical data, probability calculations, confidence levels, and success rates displayed on the Platform are mathematical computations based on historical data. They reflect past patterns and do not predict future events.
2. A high statistical probability (e.g., 85% confidence) does NOT mean the event will occur. In sports, low-probability events regularly occur. Statistics describe tendencies, not certainties.
3. The AI system processes data according to a defined analytical schema. Changes in this schema, data sources, or external conditions may affect the quality and accuracy of analyses at any time.
4. Displayed success rates, hit rates, or performance metrics relate to specific past periods and specific market conditions. These metrics are not transferable to future periods or different market conditions.
5. The user acknowledges and agrees that no statistical model, regardless of sophistication, can account for all variables affecting sports outcomes, including but not limited to: last-minute lineup changes, player motivation, weather conditions, referee decisions, and random events.

1. The processing of personal data is governed by the Operator's separate Privacy Policy, available at /datenschutz.
2. The Operator processes data in compliance with the EU General Data Protection Regulation (GDPR) and applicable German data protection laws.
3. By using the Platform, the user acknowledges the collection and processing of personal data on the legal bases described in the Privacy Policy (Art. 6(1)(b) and Art. 6(1)(f) GDPR). A separate consent is not required for technically necessary processing.

1. All content on the Platform including text, graphics, logos, software, AI algorithms, data models, analyses, and any other materials are protected by copyright and intellectual property laws.
2. Reproduction, distribution, modification, reverse engineering, or commercial use of any content without express written permission from the Operator is strictly prohibited.
3. The AI system, its algorithms, analytical schema, and outputs are proprietary to the Operator. Any attempt to copy, replicate, or extract these constitutes a violation of these GTC and applicable law.

1. The Operator does not guarantee uninterrupted, error-free, or continuous availability of the Platform. Maintenance, updates, or technical issues may result in temporary or extended unavailability.
2. The Operator may modify, suspend, or discontinue any feature, content, or the entire Platform at any time without prior notice. No claims arise from such changes.
3. The Platform's availability may vary by region. The Operator makes no representation regarding the legality of the service in any specific jurisdiction.

1. The Operator is NOT a licensed betting operator or gambling provider within the meaning of the German Interstate Treaty on Gambling (GlüStV 2021) or any other gambling regulation.
2. The Platform provides statistical analysis services. The Operator acts as an information provider and not as a gambling operator.

1. The contractual relationship between the user and the Operator begins upon registration on the Platform and is concluded for an indefinite period. The free basic access (without VIP Pass) constitutes a continuing obligation.
2. VIP Passes have a fixed contract term of 30 days from activation. After expiration, the contract automatically reverts to the free basic access. There is no automatic renewal.
3. The user may terminate the contractual relationship at any time by deleting their account. Deletion can be requested via email to [email protected]. Active VIP Passes are not refunded upon voluntary termination.
4. The Operator may terminate the contractual relationship for cause with immediate effect, particularly in the event of: material breach of these GTC, suspected fraud or abuse, violation of the Single-Device Policy, unauthorized redistribution of content, or court or regulatory orders.
5. Upon termination of the contractual relationship, the user's right to access the Platform and all associated services expires immediately. Stored data will be processed in accordance with the Privacy Policy and applicable data protection law (Art. 17 GDPR).
6. In the event of extraordinary termination by the Operator due to user fault, no claims for refund, compensation, or damages arise for the user.

1. In the event of unauthorized redistribution of VIP content (tips, analyses, AI recommendations) — including sharing via messengers, social media, forums, screenshots, or any other medium — a lump-sum damage of up to €5,000 per incident shall be payable. The user retains the right to prove that the actual damage was lower; the Operator retains the right to prove that the actual damage was higher.
2. In the event of account sharing or multi-device abuse in violation of §6a, the Operator is entitled to claim lump-sum damages of up to €1,000 per incident in addition to the immediate termination of the account. The user may prove that no damage or a lesser damage has occurred.
3. Attempts to reverse-engineer, copy, or extract the AI system's algorithms, data models, or analytical methods shall incur lump-sum damages of up to €25,000 per incident. The user may prove that the actual damage was lower; the Operator reserves the right to claim damages exceeding this amount if proven.
4. Automated access to the Platform (bots, scrapers, crawlers) without express written permission constitutes a contractual violation and entitles the Operator to claim damages, including but not limited to server costs, lost revenue, and legal fees.
5. The above lump-sum damages represent a reasonable estimate of the typically expected damage and are subject to judicial review of their appropriateness (§ 309 Nr. 5 BGB). The right to claim proven actual damages beyond these amounts remains unaffected.

1. The Operator shall not be liable for any failure or delay in performing obligations under these GTC to the extent such failure or delay results from circumstances beyond the Operator's reasonable control (Force Majeure).
2. Force Majeure events include but are not limited to: natural disasters, pandemics, wars, terrorist acts, government actions, sanctions, cyberattacks, DDoS attacks, data center failures, power outages, internet backbone disruptions, failures of third-party API providers, and changes in law or regulation.
3. In the event of Force Majeure, the Operator's obligations are suspended for the duration of the Force Majeure event. Active VIP Pass durations are NOT extended by Force Majeure periods, unless the Operator decides otherwise at its sole discretion.
4. The Operator shall make reasonable efforts to resume services as soon as practicable after the Force Majeure event ceases.

1. The Operator is committed to compliance with all applicable laws and regulations, including but not limited to: the German Telemedia Act (TMG/DDG), GDPR, the German Civil Code (BGB), and applicable EU consumer protection directives.
2. Although the Operator is NOT a gambling provider, the Operator supports anti-money laundering (AML) efforts. Suspicious activities — including but not limited to fraudulent registrations, chargeback fraud, or use of the Platform for illegal purposes — will be reported to the relevant authorities.
3. The Platform implements technical age verification measures. Users under 18 years of age are strictly prohibited from accessing and using the Platform. The Operator reserves the right to request age verification documentation and to block accounts in case of doubt.
4. The Operator does not process payments for gambling or betting purposes. All financial transactions processed through the Platform (VIP Pass payments via Stripe) relate exclusively to the purchase of digital analysis services and are subject to standard consumer protection regulations.
5. The Operator cooperates with regulatory and law enforcement authorities upon lawful request. The Operator may disclose user data to authorities in compliance with applicable data protection law if legally required.

1. Az ezen a platformon használt MI-rendszer a minimális kockázatú MI-rendszerek kategóriájába tartozik az (EU) 2024/1689 rendelet (EU AI Act) értelmében. Nem minősül magas kockázatú MI-rendszernek a rendelet 6. cikke és III. melléklete értelmében.
2. Az (EU) 2024/1689 rendelet 50. cikke (átláthatósági kötelezettség) alapján ezennel nyilvánosságra hozzuk: az ezen a platformon található elemzési eredmények, előrejelzések és ajánlások MI-rendszer által kerülnek előállításra. Ez különösen vonatkozik minden statisztikai értékelésre, a csevegőasszisztensre és a mecsnapi elemzésekre.
3. Az MI-rendszer nem hoz autonóm döntéseket jogi vagy hasonlóan jelentős hatással a felhasználókra. Minden kimenet kizárólag tájékoztatási és szórakoztatási célokat szolgál. Az MI-kimenetek alapján hozott döntésekért kizárólag a felhasználó felelős.
4. Az üzemeltető kötelezettséget vállal az (EU) 2024/1689 rendelet követelményeinek betartására, valamint az MI-rendszer üzemeltetésére, felügyeletére és szükség szerinti kiigazítására az alkalmazandó előírásoknak megfelelően.

1. These GTC are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
2. The place of jurisdiction for all disputes arising from or in connection with these GTC is the registered office of the Operator (Pfullendorf, Germany), insofar as legally permissible.
3. If any provision of these GTC is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the economic intent of the original.
4. The Operator reserves the right to assign any rights and obligations under these GTC to a third party without the user's consent.
5. The failure of the Operator to enforce any right or provision of these GTC shall not constitute a waiver of such right or provision.
6. These GTC represent the entire agreement between the user and the Operator regarding the use of the Platform and supersede all prior agreements.
7. The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr — We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.
